Copyright Policy

All copyrights over any content uploaded by any User to Pheditor on the Site shall remain the sole and exclusive property of such User. The Users retain full rights to distribute their own work, images or any other kind of content (“Content”) without prior consent from Pheditor. It is not acceptable to copy or save another User's Content from Pheditor and upload to other sites for redistribution and dissemination.

By uploading Content to Pheditor You give Pheditor permission to use or distribute your Content on the Site or affiliated sites.

You retain all ownership rights to Content uploaded to Pheditor. However, by submitting Content to Pheditor, You hereby grant Pheditor a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Pheditor's services and Pheditor's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the services (and derivative works thereof) in any media formats and through any media channels.

You also hereby grant each User of the services a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the services and under the Site’s Terms of Use. The above licenses granted by You in media Content You submit to the services terminate within a commercially reasonable time after You remove or delete your media from the Service provided that any sub-license by Pheditor to use, reproduce or distribute the Content prior to such termination may be perpetual and irrevocable.

You understand and agree, however, that Pheditor may retain, but not display, distribute, or perform, server copies of your Content that have been removed or deleted. The above licenses granted by You regarding Contents You submit are perpetual and irrevocable. Deleted Content is only accessed by us in the event of a legal issue or litigation. If You are a copyright owner or an agent thereof and believe that any User submission or other Content infringes upon your copyrights, You may submit a notification by providing our copyright agent (“Copyright Agent”) with the following information in writing:

  • A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
  • Information reasonably sufficient to permit the service provider to contact You, such as an address, telephone number, and, if available, an electronic mail;
  • A statement that You have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that You are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

You acknowledge that if You fail to comply with all of the above listed requirements your notice may not be accepted by us.

If You believe that your User submission that was removed (or to which access was disabled) is not infringing, or that You have the authorisation from the copyright owner, the copyright owners agent, or pursuant to the law, to post and use the Content in your User submission, You may send a counter-notice containing the following information to the Copyright Agent:

  • Your physical or electronic signature;
  • Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled;
  • A statement that You have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; and
  • Your name, address, telephone number, and e-mail address, a statement that You consent to be submitted to the jurisdiction of the courts of the state of Victoria, Australia and a statement that You will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, Pheditor may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it within ten (10) business days. Unless the copyright owner files an action seeking a court order against the Content provider or User, the removed Content may be replaced, or access to it restored, within ten (10) to fourteen (14) business days or more after receipt of the counter-notice, at Pheditor 's sole discretion.

Pheditor will terminate the access to the Site of any User who repeatedly infringes the copyrights of others.
